A shop policy outlines the details for purchases of physical products. It lives on your online shop, and sets out the terms of all your shop policies. This is something you’ll have all your online customers agree to before purchasing any of your stuff. That way, you’re able to enforce your policies if/when needed.

If you’re selling physical products online, yes.

I strongly suggest using your own, yes. 

Why? When an e-commerce platform like Etsy provides you with a shop policy, the terms are typically pretty general. They rarely cover the specifics of your business. When you default to them, you’re automatically pigeon-holed into terms the platform created that don’t reflect the way YOU want to do business. What’s worse? Generic shop policies are usually gaping with holes, leaving you wide open to a lawsuit at worst, or constant legal headaches at best.

Having your own shop policy helps you clearly communicate (and enforce) ALL your desired policies around refunds, returns, shipping, exchanges etc. It also ensures you’re covered by establishing all legal disclaimers, relevant to your unique business. This is particularly important if your physical products are in the health and wellness space.

If you don’t have one, you can become liable for any harm your physical product may inadvertently cause a customer. This is especially important if you’re in the health & wellness space. A good shop policy will include any relevant health disclaimers your products need.

Furthermore, if you don’t have a shop policy, you can’t enforce ANY of your policies, including refunds, chargebacks, credit card policies, etc.

Technically your store becomes an online free-for-all.

Customers have the right to complain (and possibly sue) if you don’t honor refund requests you might think are ridiculous. If your items are health products and you don’t have the appropriate disclaimers, written in the right way — you could be blamed if something horrible happens.

If someone posts a negative review online about a policy you have, but they never “checked a box” on said policy, then you can’t defend yourself publically with a smart “actually the terms you willingly agreed to stated this” type comment. 

The amount of potential nightmares when it comes to an e-commerce shop that’s legally unprotected are endless. The right shop policy will nip all them in the bud.
